We are investigating potential claims against violators of the TCPA. Each violation can lead to penalties of $500.00 or $1,500.00 per unlawful text. We believe there may have been such violations and are presently investigating this matter.
Is it worth it to pursue a lawsuit for the TCPA penalties of $500 or $1,500 per violation?
Most lawsuits are filed over substantially more damages than those amounts. However, many TCPA lawsuits are filed as “class actions” where one lawsuit is filed on behalf of many persons with smaller dollar value claims. If many people are unlawfully texted, the total value of the claim can reach millions of dollars.
How do I know if I consented to receive any such texts?
Many of the texts are made without you giving any prior consent, which is illegal. However, sometimes there is a clause in a written contract between parties that includes such consent, or perhaps in a prior account registration, you were asked if the company could send text messages at your cellphone number. That is consent. But if there has not been such a prior conversation or contract, there is no consent and such texts are illegal. However, even if you gave consent at some point, you can avoid future texts by revoking such consent by telling the texting party that you do not want to receive such texts anymore. If you receive another text to your cellphone after such revocation of consent, that would likely be a TCPA violation by the company.
What is a Class Action?
A "class action" is a lawsuit brought by one or more claimants as representatives for an entire group of claimants who have been affected by a common violation but who do not need to participate in the lawsuit in order to be awarded a recovery. A class action suit may occur when many different people combine their similar complaints. This saves court time and allows a single judge to hear all the concerns at the same time, and come to one settlement or resolution for all parties. This process creates a procedure for redressing a relatively small claim that might otherwise be too costly to litigate on an individual basis.

I don’t have records of all my texts. Can I still recover damages?
Possibly. You don’t need to have exact records of all your texts. Your own testimony and the testimony of others is evidence of what happened. In addition, the entity usually keeps records of all such texts made and we can determine from those records which cellphone numbers were texted.
